Wembley Police Station No Further Action Affray &Threats to Kill

Mr Peter Mulhearn, one of our Senior Consultant Criminal Solicitors, attended Wembley Police Station on 21st October 2024 to represent a known client to the firm. Our client had been arrested on suspicion of affray contrary to section 3(1) of the Public Order Act 1986, and making threats to kill contrary to section 16 of the Offences Against the Person Act 1861, an offence which carries a potential sentence of 10 years imprisonment.

It was alleged that our client, whilst intoxicated, had begun swearing at and threatening other residents within his shared accommodation, whilst holding various instruments including an empty wine bottle, a knife and plank of wood with nails embedded in it. It was further alleged that during this incident our client had warned the other residents to all lock their doors on the night in question as he planned to kill them all.

Mr Mulhearn spoke with the client who averred that in fact it was the other residents that had ganged up and been threatening towards him. He denied threatening anyone or wielding any sort of item as a potential weapon. On the basis of our clients account, Mr Mulhearn advised that he give a fully commented interview, answering all questions posed to him as he believed the best thing for the client in this situation was for him to put forward his seemingly credible account to the Police at the earliest opportunity. The client accepted this advice, and the interview went ahead.

Upon conclusion of the interview, the Police informed our client that he was free to leave the Police Station and that they would be taking no further action against our client in relation to the incident.
