Rape dropped Charing Cross Police Station 2022
Our client faced an elaborate false rape allegation at the police station following a one night stand. He attended the police station by appointment where the police had pre arranged a duty solicitor. The duty solicitor who was not a qualified lawyer but a representative was advised by the police that a written statement had been taken from the alleged victim. The duty solicitor advised the client to make a no comment interview, despite the fact that our client had an excellent and credible account to advance as his defence, that the intercourse had been consensual. Our client was a well educated regulated professional and suspected that the advice was bad advice. The duty solicitor argued with our client about the advice given to him when he was challenged about this. The police were so concerned about the poor advice from the duty solicitor that they advised our client to seek a specialist firm and unusually reorganised the interview at a later date.
Our private team met with our client on the weekend and gave early advice. We attended the police station and advised our client to give a full comment interview denying the allegation. The other firms bad advice could have lead to our client being charged with rape. We allocated 3 team members to the case and we conducted a thorough advanced examination of our clients version of facts. We acted rapidly to secure evidence to support the defence. Our client was in the process of leaving the UK for an excellent once in a life time job opportunity abroad. Our client required the case to be dropped swiftly. We spoke to witnesses and conducted a CCTV search. We made strong written representations to the police explaining the events which ultimately led to the police dropping the case and ending our clients nightmare. Having an incompetent solicitor giving poor advice can lead to dire consequences.
