Produce Indecent Image And Sexual Assault Out Of Court Disposal Caution

We were instructed to represent a 16 year old boy who was being investigated for an offence producing an indecent image and sexual assault. The allegation involved taking a picture under a duvet of a female friend who was also a minor during a sleep over. Were reluctant to put forward an acceptance of guilt on the producing the image offence as this would have resulted in a caution and registration on the sex offender registered. As there was an element of sexual touching as part of the allegation, we submitted an admission on that alone. The case was reviewed fully by the Youth Offending service and in light of our client’s good character and acceptance of guilty he received a caution. A caution for sexual assault by touching does not carry a notification requirement on the sex offender register.
