Assault Case Dropped No Further Action Colindale Police Station 2024
Umar Zeb attended Colindale police station to a client in custody for assault. We were called as duty solicitors at short notice, where we provided free advice under the legal aid scheme. A third party had called the police complaining that our client had assaulted the female occupant, his wife. On police attendance, officers alleged that the client had assaulted his wife by pulling her away from the door. We were not shown body-worn footage, which was claimed to have captured the assault. The female occupant was unwilling to provide a statement to the police. We strongly advised our client not to answer police questions and ensured he was reminded of this advice during an interview, where he was encouraged to speak by the police. The police can pursue victimless prosecutions even in the weakest of cases. Talking in interviews can lead to adverse damage to a case and self-incrimination in weak cases. Our client was released following the interview with no further action returning to his home.
