Suspended Sentence supply class A Basildon Crown Court 2022
Our client was charged with possession with intent to supply class A drugs. Police carried out a routine stop of a vehicle and our client was the sole occupant/driver. A search of the vehicle identified a black sock filled with small bags of white powder concealed in the leather casing around the gear stick. A s18 house search was authorised of premises and approximately £1,000 of cash was seized. The white powder located in the vehicle consisted of 89 bags in total and combined weight of all the bags was 28.53g. This was tested by scenes of crime and confirmed as Cocaine. The approximate street value of the combined weight was a total £2,900.
The evidence was overwhelming and the starting point for street dealing class A drugs at this level is 3 years custody with a range of 2 – 4 years and 6 months custody. Our client pleaded guilty early to secure maximum credit. We prepared a strong mitigation bundle. We agreed a sentencing note with the CPS in advance and instructed an experienced barrister to undertake a preparatory conference with our client. We were able to persuade the court to impose a 24-month suspended sentence with community elements. Our client is now able to move on with his life and start a fresh chapter with this behind him.
