Not Guilty - S18 GBH - Stabbing ID evidence /Phone cell Site evidence excluded
We successfully defended a 16 year old autism sufferer charged with 4 others jointly. He was identified by the victim and allegedly placed at the scene by his mobile phone.
We were able to exclude the telephone cell site by way of a S.78 PACE application. The ID evidence was weakened by vigorous cross-examination at trial by our counsel, leading to a verdict of not guilty and the case being dismissed following a submission of no case to answer.
Our team of Solicitors, James O’Donnell and Umar Zeb, worked extremely hard with a very vulnerable individual to achieve an outcome which resulted in avoiding a lengthy youth sentence.
