Umar Zeb was instructed on a limited basis by the Court to conduct cross-examination of police officers only at trial. Our client was found not guilty of assault on an emergency worker namely a police officer from Wembley Police Station. Our client was restrained by response officers on the ground with force during very cold and wet weather during the winter period. Our client who was face down on the ground at night was in pain when he momentarily attempted to move himself to make himself more comfortable. The officer alleged an intentional kick that caused pain. The CPS withheld the body-worn evidence that we were able to obtain at trial and play to the court. We were able to advance the fact that this was accidental and caused by the police while using excessive force. The court was persuaded that the prosecution could not prove intentional or reckless assault. Senior Partner Umar Zeb undertook the defence case on a free probono basis.
