Community Order Secured Stalking Highbury Corner Magistrates Court 2024
We represented a client charged with s.2A Stalking. The Crown argued that the offence was committed over a prolonged period, and caused very serious distress. This placed the offence at 1A on the sentencing guidelines with a starting point of 12 weeks in custody. We were successfully able to put the offence into context and argued that whilst there was some distress, it wasn’t very serious to warrant the highest category. The Court accepted our submissions and agreed it fell into a lower category of 2B and imposed a community order on our client.
